General Terms and Conditions

1. Scope, Provider

1.1 These General Terms and Conditions (GTC) apply to all contracts that you conclude with us via our online shop at www.beauty-cosmetics.de.

1.2 Your contractual partner is bcb Beauty Cosmetics Berlin UG (haftungsbeschränkt), Wexstraße 39, 10715 Berlin, represented by the Managing Director Siegfried Tollkühn, Commercial Register Amtsgericht Charlottenburg (Berlin) HRB 143178 B, Phone +49 30 854 67 79, Email kontakt@beauty-cosmetics.de (hereinafter "we" or "us").

1.3 Our offer is directed at consumers as well as commercial enterprises. Deviating terms and conditions of the customer shall not apply unless we expressly agree to them in writing.

2. Conclusion of Contract

2.1 The presentation of products in the online shop does not constitute a legally binding offer, but rather an invitation to place an order.

2.2 You can place products into the shopping cart and select your data, shipping method, and payment method during the checkout process. Before submitting your order, you will see a summary of your order and can correct input errors using the "Back" or "Edit" buttons or by modifying your entries. By clicking the button "Order with obligation to pay" (or an equivalently labeled button), you submit a binding offer to purchase the goods in the shopping cart.

2.3 We immediately confirm receipt of your order by email. This order confirmation does not yet constitute acceptance of your offer. The contract is concluded when we accept your order by a separate confirmation email or when we dispatch the goods. In the case of payment methods credit or debit card, PayPal, Klarna, and Apple Pay, the contract is concluded upon completion of the payment transaction.

2.4 The contract language is German. Translations of these GTC are provided for informational purposes only; the German version is legally binding.

2.5 We store the text of the contract and send you the order details and these GTC by email. If you have registered a customer account, you can review your past orders in your customer account.

3. Prices and Shipping Costs

3.1 All prices are final prices in Euro and include statutory value-added tax (VAT). For deliveries to countries outside the European Union, no German VAT applies; the price will be adjusted accordingly once you enter the delivery address. Local import duties and taxes may apply, which must be borne by you as the recipient.

3.2 In addition to the stated prices, shipping costs apply unless free shipping is indicated. Shipping costs and the conditions for free shipping can be found on the "Shipping and Payment" page and during the order process.

4. Delivery

4.1 We deliver to the countries listed on the "Shipping and Payment" page. Delivery times are stated there and on the respective product pages.

4.2 You may collect your order from our store in Berlin by prior appointment if you select "Store Pick-up" during the ordering process.

4.3 Partial deliveries are only made if reasonable for you; no additional shipping costs will arise for you as a result.

5. Payment

5.1 The available payment methods are displayed on the "Shipping and Payment" page and during the order process.

5.2 Payments by credit or debit card, PayPal, Klarna, and Apple Pay are processed via Mollie B.V., Keizersgracht 126, 1015 CW Amsterdam, Netherlands. For Klarna, the terms of Klarna apply additionally.

5.3 In the case of advance payment (bank transfer), you transfer the invoice amount within 7 days of contract conclusion to the bank account specified in the order confirmation. We ship after receipt of payment.

5.4 Purchase on account (invoice) is offered exclusively to customers who have been approved by us for this method. The invoice amount is due without deduction within 14 days after receipt of the goods.

5.5 For collection in our store, you can pay in cash.

6. Retention of Title

The delivered goods remain our property until full payment has been received.

7. Right of Withdrawal

Consumers are entitled to a statutory right of withdrawal. Details can be found in our instructions on withdrawal. You may also declare your withdrawal via the "Revoke contract" function in the online shop.

8. Warranty and Liability

8.1 Statutory warranty rights apply.

8.2 We are liable without limitation for damages arising from injury to life, body, or health, in cases of intent and gross negligence, under the Product Liability Act, and within the scope of any express warranty given. In the event of a slightly negligent breach of a material contractual obligation (the fulfillment of which makes the proper execution of the contract possible in the first place and on compliance with which you may regularly rely), our liability is limited to typical, foreseeable contractual damages. In all other respects, liability for slight negligence is excluded.

8.3 For cosmetic and skincare products, please observe the information on ingredients and application instructions on the product packaging and the product detail page, especially in case of known allergies.

9. Customer Account

You may create a customer account or place orders as a guest. Please keep your login credentials confidential. You can request the deletion of your account at any time by sending a message to kontakt@beauty-cosmetics.de.

10. Dispute Resolution

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

11. Applicable Law

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers, this choice of law applies only to the extent that it does not deprive the consumer of the protection granted by mandatory provisions of the law of the state in which the consumer has their habitual residence.
